Welcome to Don't Forget! These Terms of Service ("Terms") govern your use of the Don't Forget mobile application ("App") operated by Reely AI, Inc. ("we," "us," or "our").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our App.

Age Requirement: You must be at least 13 years old to use our App. If you are between 13-17, you need parental consent.

2. Description of Service

2.1 Core Features

Don't Forget is a language learning application that provides:

• Voice Input: Save vocabulary using on-device speech-to-text technology
• Spaced Repetition: Scientifically-optimized review intervals for better retention
• Smart Notifications: Personalized quiz reminders based on your schedule
• Multi-Language Support: Learn vocabulary in 50+ languages
• Progress Tracking: Visual analytics of your learning journey

2.2 Service Availability

We strive to keep the App available 24/7, but we do not guarantee uninterrupted service. We may need to perform maintenance, updates, or experience technical difficulties.

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate and complete information when creating your account
• You are responsible for maintaining the confidentiality of your login credentials
• You must immediately notify us of any unauthorized use of your account
• One person may not maintain more than one account

3.2 Account Security

You are solely responsible for all activities that occur under your account. We recommend using a strong, unique password and enabling any available security features.

3.3 Account Information

You may update your account information at any time through the App settings. We reserve the right to verify the accuracy of information you provide.

4. User Content and Conduct

4.1 Your Content

You retain ownership of the vocabulary, notes, and other content you create using the App ("User Content"). By using the App, you grant us a limited, non-exclusive license to:

• Store and process your content to provide our services
• Synchronize your content across your devices
• Create anonymized, aggregated analytics to improve our services

4.2 Acceptable Use

You agree NOT to use the App to:

• Violate any applicable laws or regulations
• Infringe on others' intellectual property rights
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use automated tools to access or interact with the App

5. Subscription Plans and Billing

5.1 Free vs. Premium

• Free Users: 50 vocabulary notes, 5 daily notifications
• Premium Users: Unlimited vocabulary notes, 50 daily notifications, advanced analytics

5.2 Billing and Payments

• Subscriptions are billed through the Apple App Store
• Payments are charged in advance for each billing period
• Prices may vary by region and are subject to applicable taxes
• Auto-renewal can be disabled in your App Store account settings

5.3 Refunds

Refund requests are handled by Apple according to their policies. We cannot process refunds directly. Contact Apple Support for refund assistance.

5.4 Price Changes

We may change subscription prices with 30 days notice. Existing subscribers will be grandfathered at their current price for one billing cycle.

6. Intellectual Property Rights

6.1 Our Rights

The App, including its design, features, algorithms, and content (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

6.3 Trademark Usage

"Don't Forget" and our logo are trademarks of Reely AI, Inc. You may not use our trademarks without our prior written consent.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Voice Processing: We want to emphasize that we do NOT store voice recordings. All speech-to-text processing happens on your device, and only the resulting text is saved to your vocabulary list.

8. Service Modifications and Availability

8.1 Service Changes

We may modify, suspend, or discontinue any part of the App at any time. We will provide reasonable notice of significant changes.

8.2 Updates

We may release updates to improve functionality, security, or user experience. Some updates may be required for continued use of the App.

8.3 Third-Party Services

The App may integrate with third-party services (like Apple's notification system). We are not responsible for the availability or functionality of these services.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through the App settings. Upon deletion, your data will be permanently removed according to our Privacy Policy.

9.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our Privacy Policy
• Engage in fraudulent or harmful activities
• Fail to pay subscription fees
• Create security risks for other users

9.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. We may retain some information as required by law or for legitimate business purposes.

10. Disclaimers and Limitation of Liability

10.1 Service Disclaimer

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, secure, or always available.

10.2 Learning Results

While our App is designed to help with language learning, we cannot guarantee specific learning outcomes. Results vary based on individual effort and circumstances.

10.3 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules.

12.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

Continued use of the App after changes take effect constitutes acceptance of the new Terms.
